I have been a lawyer in Portland Oregon for over 13 years and have helped hundreds of people solve their financial problems. May 2006 The "New" Bankruptcy Law is now 2 1/2 years old!Well, it has now been over 2 years since congress decided to rework the bankruptcy laws, so they are not really all that new anymore. I think we have had enough time now to start to see some trends and the real impact these changes have had on the people filing bankruptcy, their lawyers and the court. For someone considering filing a bankruptcy in Oregon, the current law requires some extra work for you and your attorney such as the detailed review of credit reports, pay stubs, tax returns and other financial records. Also, the mandatory credit counseling has not been much of a burden on my clients. It really has only been difficult for people without internet access. Those that have internet access can do the counseling online and it costs about $36. Yes there are other changes that have had an effect on some filers, but I can state with confidence that, for most people, if you have debt problems, bankruptcy can still help. In fact, what you will find is that many of you will get exactly the same great result under the current law, as you would have received under the old law. Filing a Bankruptcy in Oregon Now?Is filing still worth it even with the extra paperwork and costs? In many cases, yes, especially in times like this with minimum credit card payments going up, gas and heating costs going through the roof, and interest rates that just keep going up. Filing bankruptcy does a lot of things, and one of the main things it did under the old law...and still does under the new law...is to help you and other good, honest, hard-working people get rid of burdensome debts and get bill collectors under control.
