Frequent Bankruptcy Questions

Welcome to Brian-Wheeler.com.

Welcome, and thank you for visiting www.brian-wheeler.com.  I have been a  lawyer in Portland Oregon for over 13 years and have helped hundreds of people solve their financial problems. Sometimes this means filing a bankruptcy case, sometimes it another approach is better.  I am licensed to practice law in Oregon and can only represent Oregon residents. If you live in another state, please call  your local bar association to find a lawyer in your state. I  am available to provide bankruptcy help if you live in any of the following counties: Multnomah, Clackamas, Washington, Columbia, Yamhill and Hood River

I understand that even thinking about filing a bankruptcy brings up many emotions and worries, and trying to choose a lawyer to help you through the bankruptcy filing process is not easy either.  Let’s face it, there are many bankruptcy attorneys in Oregon and, unless you were referred to me from someone you know and trust, you do not know much about me. I hope that after browsing through this website you will learn enough to feel comfortable contacting me via email or the telephone to schedule a free consultation.  Bankruptcy is a legal and moral option for people that need help. My initial consultations are always free* and there is no pressure to “sign up.”  You do not need to bring any money to the first meeting.

What recent clients say....

“I would just like to thank you very much for helping us out in such a trying time. You were very professional and in no way made us ever feel like we were "bad people". We came to you with only days before we lost our home (because others said they could help and left us our to dry) and you were able to help us file bankruptcy and keep our home. I am very grateful and will recommend you to anyone who needs a good attorney. Again I want to say thank you from the bottom of my heart.” Respectfully Mrs. H.  May 2006

The "New" Bankruptcy Law is now 2 years old!

Well, it has now been over 2 years since congress decided to rework the bankruptcy laws, so they are not really all that new anymore.  I think we have had enough time now to start to see some trends and  the real impact these changes have had on the people filing bankruptcy, their lawyers and the court.

For someone considering filing a bankruptcy in Oregon, the current law requires some extra work for you and your attorney such as the detailed review of credit reports, pay stubs, tax returns and other financial records. Also, the mandatory credit counseling has not been much of a burden on my clients. It really has only been difficult for people without internet access.  Those that have internet access can do the counseling online and it costs about $36.  Yes there are other changes that have had an effect on some filers, but I can state with confidence that, for most people, if you have debt problems, bankruptcy can still help. In fact, what you will find is that many of you will get exactly the same great result under the current law, as you would have received under the old law.

Filing a Bankruptcy in Oregon Now?

Is filing still worth it even with the extra paperwork and costs? In many cases, yes, especially in times like this with minimum credit card payments going up, gas and heating costs going through the roof, and interest rates that just keep going up. Filing bankruptcy does a lot of things, and one of the main things it did under the old law...and still does under the new law...is to help you and other good, honest, hard-working people get rid of burdensome debts and get bill collectors under control. It can also do many other things like the following

  • Stop garnishment.
  • Stop foreclosures.
  • Stop harassing phone calls.
  • Prevent utility shut offs
  • Stop car repossessions.
  • Get rid of taxes (yes it can be done).
  • Pay off back child support.
  • Stop license suspensions.
  • Reduce unhealthy stress.

How to get started.

You can start the process toward solving your financial problems and rebuilding the credit rating you deserve by calling me at (503) 284-0994, emailing me at brian@brian-wheeler.com or using my contact form or online appointment page to arrange a free office or telephone consultation.  You may also want to look at my questionnaire to see  what information will be needed to get a case filed.
